1. Introduction

1.1 WEENCOO OÜ, a company registered under Estonian law with the Estonian Commercial Register under number 16869639, and headquartered at Ahtri tn 12, Kesklinna linnaosa, Tallinn 15551, Harju maakond, Estonia (“DocOnTrip”), is the developer and operator of the website www.docontrip.com (the “Website”), and of the mobile application DocOnTrip App (currently under development). Together, the Website and the App constitute the “Platform”.

1.2 You must accept the following terms and conditions of use (“Terms of Use”) as a condition to access and use the Platform, request medical consultations, and book related services (“Medical Services”). These Terms of Use, along with our Privacy Policy, and Disclaimer regarding Medical Practices, form a legally binding agreement between you (the “User”) and DocOnTrip upon acceptance.

1.3 By creating an account or using the Platform on behalf of another individual, you confirm you are authorized to accept these Terms on their behalf.

1.4 By clicking “I accept” or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms of Use.

1.5 DocOnTrip reserves the right to update these Terms at any time. Continued use after changes implies acceptance of the updated Terms. The latest version is always available on www.docontrip.com/terms-and-conditions.

2. Definitions

For the purpose of these Terms of Use, the following terms shall have the meanings set forth below:

  • “DocOnTrip”: Refers to WEENCOO OÜ, the operator of the Platform.
  • “Platform”: Refers collectively to the website www.docontrip.com and the DocOnTrip mobile application (App).
  • “User” or “You”: Refers to any individual accessing or using the Platform, whether as a patient seeking Medical Services or any other visitor.
  • “Medical Services”: Refers to the teleconsultations and, where applicable, in-person care or related medical services requested or booked through the Platform.
  • “Healthcare Professional(s)”: Refers to independent, licensed medical doctors, specialists, or other healthcare providers who offer Medical Services through the Platform.
  • “Account”: Refers to the personal user account created on the Platform to access and utilize Medical Services.

3. Eligibility and Account Creation

3.1 The Platform is intended for individuals aged 18 years or older. By accessing or using the Platform, you confirm you meet this age requirement. If you are under 18, you may only use the Platform under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

3.2 To access Medical Services, Users must create an Account with accurate and up-to-date personal information, including but not limited to full name, email address, phone number, date of birth, and any other required details.

3.3 DocOnTrip reserves the right to accept or reject Account applications and may suspend or terminate Accounts at its discretion, particularly if the provided information is false, incomplete, or if there is a breach of these Terms.

3.4 The User is solely responsible for keeping login credentials (username and password) secure and confidential. Any activity occurring under your Account is your responsibility. You must notify DocOnTrip immediately of any unauthorized use of your Account.

4. Scope of the Services Provided through the Platform

4.1 The Platform connects Users with independent, licensed Healthcare Professionals for teleconsultations and, where applicable, facilitates the booking of in-person care.

4.2 Users submit a request for a consultation; the Platform forwards this request to available Healthcare Professionals based on the User’s criteria. The User then receives and selects from proposed time slots.

4.3 DocOnTrip may provide general public listings of third-party providers or facilities not directly affiliated with DocOnTrip’s booking system. These listings do not imply any affiliation, endorsement, or recommendation by DocOnTrip.

4.4 All teleconsultations facilitated by the Platform are conducted securely via encrypted video and chat functionalities. Documents like prescriptions, medical certificates, or summaries may be issued by the Healthcare Professional where legally permitted and clinically appropriate.

4.5 The User independently selects the Healthcare Professional from the available options. The User expressly acknowledges and agrees that DocOnTrip is solely a technology platform provider and is not a healthcare provider, is not involved in any clinical decisions, medical diagnoses, or treatments, and does not interfere with the professional judgment of Healthcare Professionals.

4.6 THE PLATFORM IS NOT SUITABLE FOR MEDICAL EMERGENCIES. In case of a medical emergency, Users must immediately contact local emergency services (e.g., calling 112 in Europe, 911 in the USA, or equivalent local emergency numbers). DocOnTrip is not equipped to handle medical emergencies.

5. Booking Process

5.1 Users request consultations by filling in a dedicated form on the Platform, where they may specify the type of service, preferred language, and desired schedule.

5.2 Available Healthcare Professionals respond to the request with proposed time slots. The User chooses a suitable time, proceeds with payment through the Platform’s secure payment system, and receives a confirmation with all relevant details for the consultation.

5.3 If no suitable match with a Healthcare Professional is found through the Platform’s booking system, DocOnTrip may offer publicly available alternatives or general information, but any subsequent booking or payment for such alternatives will be outside the Platform’s control.

5.4 Cancellations or modifications to a booked appointment must be made at least 24 hours before the scheduled time to be eligible for a full refund or rescheduling without penalty.

6. Fees and Charges

6.1 Users will be required to pay for the Medical Services booked through the Platform using a secure payment system integrated into the Platform. Prices for each service are clearly displayed prior to booking and payment confirmation.

6.2 Healthcare Professionals are solely responsible for setting their professional fees. DocOnTrip facilitates the payment process but does not influence or dictate the pricing of Medical Services.

6.3 All payments are processed securely through third-party payment gateways. Users agree to provide accurate and complete billing information and authorize DocOnTrip or its payment processor to charge the applicable fees at the time of booking.

6.4 In case of insurance coverage, the User is solely responsible for managing any claims directly with their insurer. DocOnTrip does not intervene in reimbursement processes or communicate with insurance companies on behalf of the User.

6.5 Fees are non-refundable unless explicitly specified otherwise during the booking process or under the cancellation terms outlined in Section 7.

7. Cancellation Policy

7.1 Users may cancel or reschedule an appointment up to 24 hours before the scheduled time without penalty, typically resulting in a full refund.

7.2 Cancellations made within 24 hours of the scheduled appointment may be subject to a cancellation fee or be entirely non-refundable, depending on the individual Healthcare Professional’s policy and the specific service terms. This will be clearly communicated at the time of booking.

7.3 If a Healthcare Professional cancels an appointment, the User will be offered a full refund or the option to rebook with the same or another available professional.

7.4 Refund requests must be submitted via email to contact@docontrip.com and will be processed within a reasonable time frame, typically within 5-10 business days, to the original payment method.

8. Telemedicine Services

8.1 The Platform enables telemedicine consultations primarily via secure video and chat functionalities. Services provided through teleconsultation may include general medical advice, prescriptions (where legally permitted), referrals, and follow-up care.

8.2 Users acknowledge that teleconsultations have inherent limitations compared to in-person visits. Healthcare Professionals may not be able to perform a physical examination or have access to all diagnostic tools available in a traditional clinical setting.

8.3 While DocOnTrip strives to provide a secure system, the User is responsible for ensuring proper internet access, a suitable device, and a private, quiet environment conducive to a confidential medical exchange during the consultation.

8.4 Healthcare Professionals may not be able to issue prescriptions for certain restricted medications or controlled substances, depending on legal limitations in the User’s and/or the Professional’s jurisdiction.

8.5 Users must provide complete, accurate, and truthful medical information to the Healthcare Professional to receive appropriate care. Failure to do so may compromise the quality and safety of the Medical Services.

9. User Conduct and Prohibited Uses

9.1 The Platform may only be used for lawful, personal, non-commercial purposes, strictly in accordance with these Terms of Use.

9.2 Users agree not to:

  1. Use the Platform in any way that violates any applicable national, local, or international law or regulation.
  2. Engage in any activity that is fraudulent, abusive, harassing, defamatory, or otherwise objectionable.
  3. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  4. Submit false, inaccurate, or misleading information, particularly regarding medical history or personal identity.
  5. Interfere with or disrupt the integrity or performance of the Platform or the data contained therein.
  6. Attempt to gain unauthorized access to the Platform, its related systems, or networks.
  7. Introduce any viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
  8. Collect or store personal data about other Users without their explicit consent.
  9. Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform without express written permission from DocOnTrip.
  10. Use the Platform for any commercial endeavors other than as explicitly permitted herein.

9.3 Any misuse, unauthorized activity, or violation of these Terms will result in immediate termination of access to the Platform and may lead to legal action, including but not limited to civil and criminal penalties.

10. Limitation of Liability and Disclaimers

10.1 DocOnTrip operates solely as a technological platform facilitating access to independent Healthcare Professionals. DocOnTrip does not provide medical advice, diagnosis, or treatment itself, nor does it employ the Healthcare Professionals.

10.2 DocOnTrip is not liable for the quality, outcomes, or consequences of any medical advice, diagnosis, or treatment provided by Healthcare Professionals accessed through the Platform. All medical decisions and interactions remain solely between the User and the Healthcare Professional.

10.3 Users assume full responsibility and risk for selecting and interacting with Healthcare Professionals through the Platform. DocOnTrip makes no representations or warranties regarding the suitability, qualifications, or clinical outcomes of any Healthcare Professional.

10.4 The Platform is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

10.5 DocOnTrip does not warrant that the Platform will be uninterrupted, secure, error-free, or free of viruses or other harmful components.

10.6 In no event shall DocOnTrip, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

11. Intellectual Property

11.1 All content on the Platform, including but not limited to text, graphics, logos, images, designs, audio, video, software, and their compilation (“DocOnTrip Content”), is the exclusive property of WEENCOO OÜ or its licensors and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

11.2 Users may not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any DocOnTrip Content for any purpose without the express prior written consent of WEENCOO OÜ.

11.3 Unauthorized use of any DocOnTrip Content, including DocOnTrip’s trademarks or service marks, may result in legal action, including but not limited to claims for infringement of intellectual property rights and damages.

12. Indemnification

You agree to defend, indemnify, and hold harmless DocOnTrip, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Platform, including, but not limited to, your User Contributions, any use of the Platform’s content, services, and products other than as expressly authorized in these Terms of Use, or your use of any information obtained from the Platform.

13. Governing Law and Jurisdiction

13.1 These Terms of Use, and any disputes or claims arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of the Republic of Estonia.

13.2 Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia.

14. Miscellaneous

14.1 Entire Agreement

These Terms of Use, together with the Privacy Policy and Disclaimer regarding Medical Practices, constitute the entire agreement between you and DocOnTrip regarding the use of the Platform and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Platform.

14.2 Waiver and Severability

No waiver by DocOnTrip of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of DocOnTrip to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

14.3 Force Majeure

DocOnTrip shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond DocOnTrip’s reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation (including “line-noise” interference), acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

14.4 Assignment

You may not assign or transfer your rights or obligations under these Terms of Use without DocOnTrip’s prior written consent. DocOnTrip may assign its rights and obligations under these Terms of Use, in whole or in part, at any time without notice to you.
